Our advice often begins in the pre-litigation phase. In this phase of dispute resolution, we examine the factual and legal situation, analyse litigation and cost risks, develop options for action and promising negotiating positions. We communicate with the other side and represent our clients' interests in settlement negotiations. In doing so, we are aware that we are often dealing with long-standing business relationships that need to be preserved. We also have many years of experience in dealing with disputes, which have to be conducted extremely sensitively due to their public nature.
In the context of legal disputes, we can, if desired, take over the complete organisational and legal handling of the mandate or entire litigation contingents, up to and including the enforcement of claims in compulsory enforcement proceedings. Each of our litigators specialises in a particular insurance line or area of liability and conducts a large number of proceedings each year. This means that your lawyer is not only an outstanding expert in substantive law and the relevant case law, but also an expert in procedural law and an experienced negotiator in court. Of course, we advise and represent our clients on alternative dispute resolution (ADR) options such as arbitration and conciliation proceedings or prepare arbitration opinions.
